Terms of Service

These Terms of Service govern the use of the ManicBot platform between the Operator and the User. By using the service you accept these Terms. Operator details: Kyrylo Vdovin, contact: support@manicbot.com.
1. Definitions
- Operator (we) — the provider of the ManicBot platform: Kyrylo Vdovin.
- Service / Platform — the ManicBot software: bots, admin panel, widgets and related features.
- User (you) — any person using the service: a business customer or an end client.
- Business account / Owner — a salon or independent (personal) master who subscribes and runs booking through the platform (also referred to as a tenant).
- Master — a specialist working within a business account.
- End client — a person who books a service through a salon's bot.
- Subscription — a paid plan giving access to the platform's features.
2. The service and the Operator's role
ManicBot provides software only. We give salons tools for online booking and client communication; we do not provide beauty services and do not run any salon's business.
- We are not a party to the relationship between a salon and its clients and are not a marketplace, agent or intermediary for the provision of services.
- We do not set prices, schedules, or cancellation/no-show/prepayment policies — each salon sets and is responsible for these.
- We are not responsible for the quality, legality, performance or payment of services that salons provide to their clients, nor for disputes between them.
- The service may rely on third-party platforms (Telegram, Meta / WhatsApp / Instagram, Stripe, Cloudflare, email providers); we are not responsible for their availability, changes or policies.
3. Conclusion of the agreement and acceptance
- The agreement is concluded when you start using the service (creating an account or booking through a bot).
- If you use the service on behalf of a business, you confirm that you are authorised to bind that business.
- If you do not accept these Terms, do not use the service.
4. Subscription, trial, payment and refunds
- Business accounts may receive a trial period; after it, continued use requires a paid subscription.
- The trial is granted once per user and per salon. Creating additional accounts in order to obtain another trial — including through variants of one mailbox (plus-addressing, dots in a Gmail address), disposable email services, changing your email address, or registering under another person — is a breach of these Terms.
- Where we detect such a breach, we may end the trial, merge or suspend the linked accounts, and charge for actual use of the service. Owning several salons is provided for by the MAX plan.
- Payments are processed by our payment provider (Stripe). Subscriptions renew automatically until cancelled.
- You can upgrade, downgrade, pause or cancel your subscription in the app; changes take effect as described at the time of the change.
- Fees already paid for the current period are generally non-refundable except where required by law. We may change prices with prior notice; new prices apply from the next billing period.
5. Intellectual property
- The platform, software, design, trademarks and content created by the Operator are owned by the Operator and protected by law.
- You keep ownership of content you upload (e.g. work photos, logos, texts) and grant the Operator a non-exclusive licence to host, process and display it as needed to run the service.
- You confirm that you have the rights to any content you upload.
6. Disclaimer of warranties and limitation of liability
The service is provided "as is" and "as available". To the extent permitted by applicable law, the Operator's liability is limited as set out below. Nothing in these Terms limits the rights you have as a consumer under mandatory law.
- We do not guarantee that the service will be uninterrupted, error-free, or fit for any particular purpose.
- To the extent permitted by law, we are not liable for: lost bookings, revenue, profit or data; outages or changes of third-party platforms; inaccuracies of the AI assistant; or indirect, incidental or consequential damages.
- Where liability cannot be excluded, it is limited to the total fees you paid for the service in the period preceding the event giving rise to the claim.
- You are responsible for complying with the laws applicable to your business, including consumer-protection and data-protection (RODO/GDPR) obligations toward your own clients.
7. Suspension and termination
- We may suspend or terminate access for breach of these Terms, non-payment, abuse, or unlawful use — where possible with prior notice.
- You may stop using the service and cancel your subscription at any time in the app.
- On termination, access to paid features ends; the handling of data is governed by the Privacy Policy (/privacy).
8. Changes to the Terms
- We may update these Terms; the update date is shown at the top of the page, and material changes are communicated in a reasonable manner.
- Continued use of the service after an update means you accept the current version.
